How Long Do I Have to File a Wrongful Death Claim in Georgia?

dead marguerites

According to Georgia law, those who have suffered the loss of a loved one due to another’s negligence, has two years from the date of their family member’s passing to bring a claim against the responsible party. This two year time limit is the statute of limitations for a person to file a personal injury claim in the state of Georgia. If you wait until the statute of limitations has expired, you will be prohibited from seeking damages. It is highly recommended that you act quickly to speak with us.

There are a few exceptions to the two year statute of limitations. For example, if there is a separate criminal case in relation to the death of your loved one, the clock stops running until the criminal proceedings have ended. Also, family members are allowed to file their wrongful death claim up to seven years after the death if the decedent’s estate is subject to delay when going through the probate process. For these reasons, even if the two year limitation has passed, you may be able to seek damages.

Ms. Udunka is second to none. It is difficult to find an attorney with a great passion for their field combined with the skill set to get the job done. Ms. Udunka exhibits both qualities in the best possible way. I highly recommend her to anyone seeking assistance.
